Terms of Service
These Terms of Service (the “Terms”) govern access to Salon Standard Pro’s websites, web application, support tools, reports, and related services (collectively, the “Service”). “Customer,” “you,” and “your” mean the salon or other business that purchases or uses the Service and its authorized users. “Salon Standard Pro,” “we,” “us,” and “our” mean Salon Standard Pro, a Texas business. By purchasing a subscription, activating an account, or using the Service, you agree to these Terms, the Privacy Policy, the Subscription, Cancellation and Refund Policy, and, when applicable, the Data Processing Addendum.
1. The Service
Salon Standard Pro provides digital tools intended to help salons create, organize, review, and export pedicure cleaning and disinfection records and related operational documentation. Features may include cleaning logs, daily disinfectant records, technician and chair tracking, compliance alerts, audit history, inspection views, report exports, SDS document storage, reminders, and support messaging.
We may improve or modify features over time. We will not intentionally remove a material paid feature during a prepaid subscription period without providing a reasonable replacement, advance notice, or an appropriate remedy.
2. Eligibility, accounts, and authorized use
- Business use. The Service is offered for legitimate salon business use by persons at least 18 years old.
- Authority. An owner or authorized representative must create the Customer account and may invite technicians or managers.
- Accurate information. You must keep salon, license, chair-count, billing, and contact information accurate.
- Account security. Each user must protect login credentials and device access. You are responsible for activity under your accounts unless caused by our breach of these Terms.
- One salon license. A subscription is licensed only to the salon establishment connected to that subscription. You may not copy, resell, sublicense, publish, distribute, reverse engineer, bypass access controls, share the Service with unrelated salons, or use one paid salon account to serve additional establishments.
- Chair limits. Your active pedicure-chair count must remain within the purchased plan. You must upgrade when your chair count exceeds the plan limit.
3. Subscriptions, fees, and taxes
Subscriptions renew automatically for the billing period disclosed at checkout until canceled. Before purchase, we will show the plan, chair allowance, price, billing frequency, and any material renewal terms. You authorize the payment provider to charge the selected payment method for recurring fees and applicable taxes. Current details are in our Subscription, Cancellation and Refund Policy.
You may cancel through an available in-app billing or support option, or by emailing info@salonstandardpro.com. Cancellation stops future renewals and normally takes effect at the end of the current paid period. We may suspend access after a failed payment or material breach, subject to any notice or cure period we provide.
4. Customer Data
“Customer Data” means information or files submitted to the Service by or for Customer, including salon information, technician profiles, cleaning records, SDS documents, support messages, and screenshots. As between the parties, Customer retains its rights in Customer Data. Customer grants us a limited right to host, process, transmit, display, and back up Customer Data only as needed to provide, secure, maintain, and support the Service, comply with law, and enforce these Terms.
Customer is responsible for having all notices, permissions, and lawful bases needed to submit Customer Data, including employee or contractor information. Do not upload payment-card numbers, Social Security numbers, medical records, client health information, or other information that the Service does not request.
Cleaning records are designed to remain available for a rolling 90-day period. Texas rules currently require relevant cleaning and disinfection records to be retained for inspection for at least 60 days. Customer remains responsible for exporting and preserving any records it must keep longer. Other Customer Data is retained as described in the Privacy Policy.
SDS documents
Customer is responsible for uploading the correct, current SDS supplied by each product’s manufacturer or distributor, confirming that each file matches the product in use, and replacing outdated documents. We do not certify the accuracy, completeness, or regulatory sufficiency of an SDS.
Support access
When Customer requests support, authorized personnel may review the ticket, screenshots, device information, and relevant account or record information reasonably necessary to diagnose the issue. We do not request Customer passwords and will not ask Customer to disclose full payment credentials.
5. Regulatory and professional disclaimer
Alerts, scores, templates, and reports are organizational aids and may not identify every violation, deadline, or requirement. Rules and agency forms may change. Customer must confirm current requirements with the applicable regulator and qualified advisers. Use of the Service does not guarantee regulatory compliance, prevent a citation, or guarantee that a salon will pass an inspection.
6. Acceptable use
You may not use the Service to violate law; submit malicious code; probe or disrupt security; access another salon’s data; misrepresent records; create false compliance documentation; infringe intellectual-property or privacy rights; harass others through support; or store unlawful, harmful, or unrelated high-risk data. We may remove prohibited content or restrict access when reasonably necessary to protect users, the Service, or others.
7. Intellectual property and feedback
The Service, software, designs, workflows, branding, templates, and documentation are owned by Salon Standard Pro or its licensors and are protected by law. Except for the limited subscription right to use the Service, no ownership right is transferred. If you provide suggestions, you permit us to use them without restriction or payment, but we will not identify you publicly without permission.
8. Third-party services
The Service relies on third-party hosting, authentication, storage, payment, email, content-delivery, and notification providers. Their systems may occasionally be unavailable. Payment information submitted directly to the payment provider is governed by that provider’s terms and privacy notice.
9. Service levels and warranties
We will use commercially reasonable efforts to keep the Service available and protect Customer Data. However, internet services can experience interruptions, and previews, beta features, reminders, notifications, and third-party integrations may fail or be delayed.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SUFFICIENT TO SATISFY EVERY LEGAL OR REGULATORY REQUIREMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY. SALON STANDARD PRO’S TOTAL LIABILITY ARISING FROM THE SERVICE OR THESE TERMS WILL NOT EXCEED THE FEES PAID OR PAYABLE BY CUSTOMER FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY WHERE LIABILITY CANNOT LEGALLY BE LIMITED.
11. Indemnification
Customer will defend and indemnify Salon Standard Pro from third-party claims arising from Customer’s unlawful use of the Service, Customer Data that infringes another person’s rights, falsified records, or Customer’s breach of Sections 2, 4, or 6. We will promptly notify Customer and reasonably cooperate. Customer may not settle a claim in a way that admits our fault or imposes obligations on us without our written consent.
12. Suspension and termination
Customer may stop using the Service and cancel as described in the Subscription Policy. We may suspend or terminate for material breach, unlawful use, security risk, nonpayment, or if continued service becomes legally or technically impracticable. When reasonably possible, we will provide notice and an opportunity to cure. During an active paid period and for any export window we provide, Customer should download needed records. Certain provisions, including payment obligations, ownership, disclaimers, liability limits, and dispute terms, survive termination.
13. Changes to these Terms
We may update these Terms for legal, security, operational, or product reasons. We will post the updated date and provide reasonable notice of material changes. Changes generally apply prospectively. Continued use after the effective date constitutes acceptance, to the extent permitted by law.
14. Governing law and disputes
Texas law governs these Terms without regard to conflict-of-law rules. Before filing a claim, each party will try in good faith for 30 days to resolve the dispute by written notice. Courts located in Texas with jurisdiction over the parties will have exclusive jurisdiction, except either party may seek emergency injunctive relief to protect data, security, or intellectual property.
15. General
These Terms and the incorporated policies are the entire agreement for the Service unless the parties sign a separate written agreement. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder stays effective. A waiver must be written. Customer may not assign these Terms without our consent, except with a merger or sale of substantially all relevant assets. We may assign them as part of a reorganization, financing, merger, or sale. Neither party is liable for delay caused by events beyond reasonable control.
